Montana Construction Payment Bond Law & Deadlines

In Montana, a preliminary notice for bond rights is required to be sent to the general contractor within 30 days of your first date of work. 

In order to enforce your payment bond rights you must send the owner a notice of a claim on the bond within 90 days of the completion of the project.  This differs from most states and from federal projects which require the notice within 90 days of your last work.  A lawsuit should be filed within no sooner than 30 days and no more than six (6) months of the notice being filed with the owner.
