HB 27             B100 License Changes

                       

This bill exempts a residential small commercial contractor from being able to install elevators, and instead requires them to use a licensed elevator contractor.

HB 131          Preconstruction and Construction Lien Amendments       

           

This bill cleans up and restructures the entire Mechanic’s Lien Statute.  It does not change the law, it just changes the numbering of the sections and consolidates parts of the existing law.

HB 305          Construction Code Revisions

 

This bill is a companion bill the HB 58 and requires a structural engineer to evaluate a building built before 1975 if more than 10% of the roof sheathing is replaced.  Reroofing and water membrane replacement only, do not require review by an engineer.  This will only be the law until June 30, 2014, and there will likely be changes worked on during the interim this year and in the 2013 general session.

HB 383s1      International Residential Code Amendments

 

This bill provides an exception to an emergency escape and rescue opening provision of the adopted International Residential Code.

HB 503s2      Construction Amendments

 

This bill provides that, the interest rate applicable to a lien or bond claim is the statutory rate of 10% unless otherwise specified in a contrat; provides that the following are not exempt from providing preliminary notice of a payment bond claim or a lien: 1) a temporary labor service company, 2) a professional employer company or organization, or 3), any other entity that provides or collects for labor; requires a construction contract to contain a differing site conditions clause; and provides that a design-build construction project contract may include provision by the contractor of operations, maintenance, or financing ; and makes technical changes.  The bill also requires school construction and other public construction contracts to include a clause which identifies the rights of parties if differing site conditions are discovered after the contract is executed.

SB 28             State Construction Code Amendments

 

This bill updates the edition of the National Electrical Code, adopted by reference, to the 2011 edition; modifies an adopted amendment to the National Electrical Code; enacts a new exception to and deletes and replaces a provision of the International Building Code relating to concrete durability requirements; enacts new provisions of the International Building Code related to standards applicable to concrete elements and minimum clear floor space; and adopts local amendments to the International Plumbing Code.

SB 92s1        Department of Commerce Amendments

 

This is a follow-up bill to a bill from 2011 which eliminated the ability of unlicensed contractors using a common LLC with a licensed contractor to get around State contractor licensing requirements.  This bill requires unincorporated contractors with more than five owners who own less than 8% of the company to file ownership status reports withDOPLevery 90 days.
